General Terms of Use (DriverTrust Web App)

 

  1. Welcome to Driver Trust

These Terms of Use ("Terms") govern the use of the Driver Trust app ("App") operated by Green Convenience GmbH, c/o TechQuartier, Platz der Einheit 2, 60327 Frankfurt, Germany ("we," "us," "Driver Trust").

By using the App, you agree to these Terms of Use. If you do not agree, please do not use the App.

  1. What is Driver Trust?

Driver Trust is a digital platform for:

  • Verifying the identity and documents of drivers
  • Issuing a digital certificate of their suitability
  • Managing driver status using a traffic light system
  • Providing verification for logistics companies
  1. Scope

These Terms of Use ("Terms") apply to the use of the DriverTrust AdminPortal (hereinafter referred to as "Platform") by

  • Administrators ("Super Admins") of the contracting customer ("Customer"),
  • administrators of substructures ("Admins") and
  • other authorized employees of the customer or sub-service provider ("Viewers")

By logging in for the first time, you agree to these terms and conditions. Separate end user terms and conditions apply to drivers.

  1. Definitions
  • Platform – web-based SaaS application "DriverTrust" from Green Convenience GmbH.
  • Admin account – user account for super admins or admins with extended rights for user and data management within the client structure.
  • Viewer account – user account without modification rights
  • Client – Logically separated data area of the respective customer, including all substructures and users.
  1. Registration & access authorization

At least one super admin is appointed for each client. This person is the contact for all organizational matters and is authorized to create additional admins for sub-service providers. They can also create viewers who can only view the system.

The customer ensures that only persons who are internally authorized and trained in data protection and IT security issues are registered as super admins/admins/viewers.

Access data must be treated as strictly confidential. Any loss or suspected misuse must be reported to support immediately.

  1. Rights & Obligations

Super Admins/Admins:

  • Data integrity: Only factually correct data that is necessary for the intended purpose may be entered into the platform.
  • Role concept: Admins may only assign permissions within their own client/substructure.
  • Data protection: Admins must ensure that all affected persons (in particular drivers) have been informed in accordance with Art. 13 GDPR and that there is an appropriate legal basis for data processing.
  • Log files & monitoring: All admin actions are logged. Green Convenience reserves the right to inspect these logs in the event of security incidents.
  • Prohibited actions: Manipulation of data, reverse engineering, automated reading ("scraping") or circumvention of security mechanisms are prohibited.
  • User management: Regular review and updating of user permissions. Immediate deactivation of accounts in the event of personnel changes or suspected misuse.
  • Security obligations: Use of secure passwords, regular password updates, and activation of available security features (e.g., two-factor authentication).
  • Reporting obligations: Immediate reporting of security incidents, suspicious activities, or technical problems to support.
  • Documentation obligation: Maintain up-to-date documentation of assigned permissions and administrative changes made.
  • Confidentiality: Strict confidentiality of all data and information accessed, even after termination of employment.
  • Support cooperation: Full cooperation with technical support in troubleshooting and security checks.

Viewers:

  • Data protection: Viewers are obliged to access data only when necessary on a need-to-know basis. The creation of screenshots or other documentation is only permitted within the scope of official duties.
  • Confidentiality: Data accessed must be treated as strictly confidential and may not be disclosed to unauthorized third parties.
  • Purpose limitation: Access is permitted exclusively for business purposes. Private use is prohibited.
  • Log files & monitoring: All viewer activities are logged and can be evaluated if necessary.
  • Reporting obligation: Suspected data misuse or security incidents must be reported immediately to the administrator or support team.
  • No data extraction: The systematic reading, copying, or other extraction of data is prohibited.
  • Access security: Viewer access data must be treated as confidential and may not be passed on to third parties.
  1. Services & availability

The platform is provided as "Software-as-a-Service." Green Convenience strives for 99% availability on an annual average. Maintenance windows will be announced outside of normal business hours whenever possible.

  1. Liability

Green Convenience is liable in accordance with the provisions agreed in the main contract. Otherwise, liability—regardless of the legal basis—is limited to intent and gross negligence, unless it concerns damage resulting from injury to life, limb, or health.

  1. Termination & blocking

The customer may delete or deactivate super admin accounts, admin accounts, or viewer accounts at any time.

Green Convenience is entitled to block accounts if there is a serious violation of these terms and conditions or if system security is compromised.

After the end of the contract, admin accounts, including associated data, will be deleted or anonymized in accordance with data protection regulations.

  1. Intellectual property

All trademarks, copyrights, and other intellectual property rights to the platform remain with Green Convenience. Admins receive a simple, non-transferable right of use for the duration of the contract.

  1. Changes to the terms

Green Convenience reserves the right to change these terms with future effect if there are valid reasons (e.g., changes in the law, expansion of functions). Changes will be announced at least 30 days before they take effect by email or in-app notification. If the customer does not object within this period, the new terms are considered accepted.

  1. Legal

11.1 Applicable law

The law of the Federal Republic of Germany applies.

11.2

The place of jurisdiction is Frankfurt am Main, to the extent permitted by law.

11.3

In the event of contradictions or deviations between these Terms of Use and the Certification Agreement, the provisions of the Certification Agreement shall prevail. The Terms of Use shall apply in addition, unless they contradict the expressly agreed provisions of the Certification Agreement or individual contractual agreements.

11.3 Severability

Should individual provisions be invalid, the remaining provisions shall remain valid.

11.4 Export control

The app may be subject to export restrictions. Use abroad may be restricted.
